For alimony purposes, adultery is an act of illicit sexual behavior. If you admitted an act of illicit sexual behavior during the marriage, or if your spouse could prove you committed an act of illicit sexual behavior, you would be required to pay your spouse alimony if your spouse is considered a dependent spouse. A dependent spouse is the spouse that is substantially dependent on the other spouse for their maintenance and support.

Admitted or proven adultery or an act of illicit sexual behavior does not affect child support.
