Their behavior is certainly reprehensible, and will place them in a bad light. Their collusion could suggest that the affair was a plot to make money by suing you, that the affection of the marriage has not been destroyed, or otherwise damage their credibility.

If you can prove their collusion and the fact that the affections of the marriage were not destroyed their claim for alienation of affection will not be successful. Criminal conversation is a strict liability action, and to be successful on that claim, all ne need prove is that you had sex with his wife.

You may be entitled to an award of attorney’s fees defending the bogus AoA claim, but it would be in the judge’s discretion.
