Attorney fees

Is attorney fees included to debt incurred during marriage? Can you use that as debt while married.

When you are getting divorce is your assets, debts divided? Does this include my college debt as well?

Debts incurred during the marriage, and for the benefit of the marriage are included in martial debts. Attorney’s fees incurred as a result of an action for property distribution relating to the end of the marriage are not a marital debt as they were not incurred for the benefit of the marriage.

College debts, and student loans can be considered martial if incurred during the marriage, however the modern view is to treat student loans as the debt of the spouse who receives the benefit of the education.
