Browning v. Helff (2000) still useable case law?

NC law has been changed so that it is no longer illegal to live with someone of the opposite sex in an intimate relationship without the benefit of marriage. This was previous illegal, a class 2 misdemeanor, and made cohabitating in custody matters a much easier reason to have it modified. If your ex is involved in something illegal then it’s going to be easier to modify custody if you can prove that.
In 2006 a NC State Superior Judge, in Raleigh, ruled that this law was unconsitutional. As to how it plays part in custody matters I believe is still being debated and may vary on a case by case basis. While cohabitation may be immoral it is no longer illegal.
