Dear mdooris:

Greetings. Yes, I think that you should immediately file a Motion to Modify Child Support. Do you know how to find one?

No I do not know how to go about this. My ex-wife has told me that I am not allowed to file because they will base the child support calculation on what I made when I was in the Marine Corps, not my unemployment. If I can file for an adjustment, can I retain your firm to do this?

Dear mdooris:

Greetings. You can call our firm and our client service specialists will be able to set up an initial consultation for you where we can discuss your options.

Your ex is wrong. They cannot set your child support on an amount that no longer exists unless they prove that you are voluntarily depressing your income in bad faith, which is very difficult. Thank you.

I did set up an initial consult with you on Thursday. But, I was just informed by an email that your firm doesn’t just handle child support modification motions.

Daer mdooris:

Greetings. If you are out of Wake or Mecklenburg County, then no, we cannot handle a motion to modify child support on your behalf. Of course, if you just want to have an attorney tell you about your situation and options, you can always have a consultation with an attorney in our office. Thank you.

Hello,

I am currently paying $703 for child support. This was based on our income and daycare (which my ex-wife did not have the children in for 6 of those months). The figure was calculated about 8 months ago when I was in the Marine Corps. Since then my contract ran out and I am on unemployment. I am having trouble finding a job and have been on unemployment for over 3 months. I only receive $1608 a month and have to give her $703 of that.

?: Does being on unemployment and having this drastic change in income allow me to file to have a modification made to the child support?
