My Ex paid chronically 2 to 3 months late. My feeling is that the judge would not be very sympathetic toward her. I was told that they (CS enforcement) don’t get excited until somebody is 90 days late. IMO she is wasting her time and money. If he has paid regularly then he probably has nothing to worry about.

Don is right. Sometimes the order may state “$xxx per month”. Even if it has a ‘by the 15th of the month’, she would be wasting her time and money in going to court. She should be grateful to be receiving the support, in that there are so many other parents that do not receive it.

She’s just being controlling (IMO). I doubt a lawyer would advise her to sue.

Thank you for your input. It seems it has been one thing after another with his ex. She wants to make it as difficult as possible for us…even using their kids - very sad situation. She works for an atty and is getting free legal advice while we are paying thousands to his atty to address her unreasonable claims. Thanks again.

If there is no date specified by the order then he is in compliance as long as it is paid within the month that the payment is due.

I have a question regarding court order violations:If an individual is court ordered to pay child support, when is the individual in violation or contempt of the court order?History: boyfriend is ordered to pay CS and has been doing so but due to the way he is paid, he has to pay the CS at the end of the month. He has not missed a CS payment and he has always paid it before the month is over (just not on the first like ex wants it).Ex wants the CS on the first of the month and is threatening to go to court and charge him with contempt. . Help!!
