Contested divorce after 1 year waiting period

The divorce can be granted without resolving the other issues. There is no reason to wait on the other issues to obtain the divorce.

The response posted above is based upon the limited factual information made available and is not intended as a full and complete response to the question. The only reliable manner to obtain complete and adequate legal advice is to consult with an attorney, fully explain your situation, and allow the attorney sufficient opportunity to research the applicable law and facts required to render an accurate opinion. The basic information provided above is intended as a public service but a full discussion with an attorney should be undertaken before taking any action.

Thanks Mr. Rosen…figured as much.

I have been seeing a man for 3 years. He has been legally seperated for almost 4 years. 2 weeks ago he had his lawyer presented a request to the wife’s laywer about divorcing and settling later. She, his (ex)wife informed him that she would not consent to the divorce until they agreed on the settlement. Can she do this? Or can he proceed with the divorce and settle later. They both are NC residents and neither are insane…though I may be by the end of this. What are his rights?

A response to this would be greatly appreciated. CClements
