Court

I currently live in the state of Iowa, but my hopefully soon to be ex-husband still lives in North Carolina. If I file in North Carolina, will I be required to attend court, or can I speak to the judge via phone? I’d file in Iowa, but due to the differences between Iowa and North Carolina divorce laws the lawyers I have spoken to here want to add on a bunch of things. I just want a divorce and nothing else. I already retain full, sole, primary custody of our daughter and have child support established. I just want a divorce!

You may file for divorce here in NC. If you are seeking only an absolute divorce you will not have to be present at any hearings, and can have an attorney appear for you to get your divorce, or in some counties, you may actually be able to effectuate the entire divorce by mail.

Thank you Erin!!!
