Divorce from deported Immigrant (complicated circumstances)

I was married to my husband in April 2006. I want a divorce from him. After an abusive 10 months, I left him on February 24, 2007.

I never changed my last name during the marriage, and we never lived together throughout the duration that we were together. He was arrested in February 2009 and then taken into Immigration custody in March 2009. After being taken into Immigration custody I learned that we were married under a false name on his behalf. He was deported to Mexico after serving a year in NCDOC in April 2010. I haven’t spoken to him since a week after he was deported. 3 months after his deportation, his brother called me and told me that my husband was murdered. I asked him to send a death certificate but he said the city where they lived in Mexico doesn’t issue death certificates.

I need to know how to get the marriage divorced/annuled/voided as I have moved on with my life and want to remarry.
