Economic Misconduct

My ex-spouse used to spend money frivolously. For example, on occassions she would spend $1000.00 or month in a month on clothes. I would beg her to stop and even sent her emails asking this.

Is this an example of economic misconduct and how could I prove this, without it being used against me (her standard of living) in court???

This is not an example of economic misconduct. Economic misconduct is funds that were not used for the benefit of the marriage. An example would be spending money on a prostitute or on someone with whom your spouse was cheating on you.

The standard of living established for purposes of alimony much take into account ‘reasonable’ expenses. Depending on your joint income, she would have to show how spending $1,000 per month on clothing was reasonable, which is likely difficult to do.
