My Ex and I are legal separated since March 2011, she is looking to move to Va. In the agreement there isnt anything saying she has to stay here in NC. Can I get something that states this put in or will we have to re-look at the whole separation agreement again? She is saying if I fight her on this she will try and go after half of everything. Just lost for words right now and dont want to loss my daughter…
Unfortunately, you can not stop this move from taking place unless you file for custody on your own. Since it was not in your agreement, she is not in violation of anything by moving. Alternatively, if her moving will render your visitation impracticable, you can file for breach of contract against her, but that would be less efficient for you than seeking custody would be.
