Good day, I’m active duty Air Force and I was sent here to Portugal on a 15month tour. As stated in my Divorce decree, I was given primary physical custody of my son, with joint legal custody for both of us. But since I could not bring him here he is living with my ex in NC still. My ex, who has no job, and only gets state aid, says that I am not going to claim him because she is. Can I still claim my son on my federal return? Thank you for any help.
The parent who he actually lives with for most of the year has the right to claim the child. Unless your agreement states otherwise, she is allowed to claim him this year.
