Unfortunately, no. In order to begin separation one of you must leave the marital home. The separation requirement for filing for divorce in NC is living separate and apart from each other for one year and one day.

No, in order to be separated you actually have to live apart.

I need help. My spouse and I are working to come to an agreement on separating however he just found out today that he will be losing his job. He will not have the financial means to leave our home. Is there a way to be legally separated but still remain under the same roof?
