North Carolina does not recognize common law marriage. Cohabitation does not create any marital property rights.

The only reliable manner to obtain complete and adequate legal advice is to consult with an attorney, fully explain your situation, and allow the attorney sufficient opportunity to research the applicable law and facts required to render an accurate opinion. My question is whether marital property rights are created by a couple living together without being legally married. I’d like to know any statutes or cases that deal with this issue if someone can help steer me in the right direction to learn more about it.
