Military deployment and custody

This is the situation-mother is active duty marine-father stay home parent(before seperation)by court order mother was given primary custody and father secondary custody and ample visitation. She deploys for six months, notifying father only days before she leaves and states she is leaving children with babysitter for the 6 months.
He goes to court to object to her leaving the children with third party, her attorney uses the Soliders and Saliors Relief Act to stop any court action against her(becasue of course she is gone by now) So the children stay with the babysitter. My question is can he file contempt of court charges against her when she returns? I believe all 4 required elements for contempt of court can be proven easily.
