In order to get a divorce in NC, one must be a resident of NC for at least six months, in addition to being separated from the spouse for at least one year.

If he lives elsewhere, he can file in those states once he meets the residency and separation requirements (if any).

If he leaves this state permanently for work he would not be eligible to file for divorce here. IF he is leaving only temporarily this will still be his residence.

If his spouse still lives here he can file here no matter where he lives.
