Do I need to wait until the divorce is finalized to create a new will (selecting Single/Divorced as marital status) or can I do that now? Would it make a difference if I did one now and selected Married?
If the purpose of drafting the will is to disinherit your spouse, you should do so as soon as possible. The divorce revokes any provisions of your will in favor of your former spouse, but since you have to wait a year to obtain a divorce in NC, you should revise it on your own. You should specifically disinherit your spouse in the will. You do not have to list a marital status in your will, but if you want to, you can put that you were separated and the date of separation.
