Dear sweetsue1029:

Greetings. First, you have not provided me the right information to determine whether or not alimony will be an issue. If you are wondering about alimony, you need to determine first whether you are a supporting spouse and whether or not she is a dependent spouse.

As far as the credit cards, do you know if she used the cards during the marriage?

Dear sweetsue1029:

Greetings. If your spouse earns more income than you do, then you are the dependent spouse. If you are the dependent spouse, then you are entitled to alimony - not the other way around.

Hi again, once we separate and file for divorce, how long before i must start paying her on the bills we have gathered together since we were married…Like I said there are no children, have only been married 6 years, and we do not own any property only vehicles, and have several credit cards that are to the maximum. She says I have to help her pay these bills, even though my name is not on any of them.

Dear sweetsue1029:

Greetings. Equitable distribution - which is the division of assets and debts - is separate from the divorce. Either of you can try now to negotiate and resolve this issue prior to divorce. Once the divorce is granted and if the equitable distribution issues were not resolved in a separation agreement or in a court order, then property and debt pass to the parties’ listed on the debt.

Thank you.
