Notarized letter

If me and my partner agreed to get a letter stating the day he has left and the items he has taken and the items I will keep and what bills we are taking over and have it signed in front of a notary will that be a good form in an event that later on when we file for divorce it is proof. That way it’s showing that we agreed upon these items/bills. I’m not sure if that makes sense but if it doesn’t please let me know and I will try to explain better.

A letter or statement signed and notarized by both spouses will help, but it does not provide you with the most protection because it is not necessarily a contract. The best course of action would be to put these same terms in a separation agreement and both of you sign and have notarized the separation agreement instead of the letter.

Take a look at our Sample Separation Agreement that you can use to draft your own.
