# Prevent divorce

Can my husband prevent us from getting a divorce?

The only requirement for getting a divorce in North Carolina is that the spouses live separate and apart for one year. So long as you have been separated for a year, either party can file for divorce and the other party can’t prevent the divorce from being granted. If you separate I would make sure you can prove your separation (obtain a drivers license with your new address, change your address with the post office, etc.).
