I think this is a good question…Is it possible that the attorney your wife is meeting with does not know that they represented you previously? It should be a conflict of interest.

I think the conflict comes in that either attorney would have information that could influence the way they represent you. In all actuality, you should contact the attorney that you had previously and ask that they represent you again. Act as though you do not already know that they are representing your wife…see if that gets the conflict of interest brought up.

It is definitely a conflict of interest. How many attorneys are in your town? Two?

The scenario you are describing is a conflict of interest. You should notify your Wife’s attorney in writing as soon as possible and request that she withdraw from representing your Wife. She may not realize that she previously represented you.

I did that and her attorney withdrew from representing her.

I went to my appointment this morning and during the initial interview I was told that their office could not represent me because they represented my ex-wife (1997) in my first divorce. I understand that there are ethical issues or something.

However, the attorney that my current wife is seeing represented ME during that divorce in 1997. Why can she do this and I can’t? Seems the dtandard would be the same.
