Resuming affair relationship

If the non-dependent spouse had an affair, and

  • was forgiven
  • pays alimony
  • has a quit-claim to future alimony claims
  • has physical custody of the kids
  • has a clause in the agreement saying they can date as if unmarried
  • has a clause in the agreement that says the other spouse won’t sue for aa/cc for whoever they date

then what are the risks in resuming the affair relationship while separated? Would this be considered adultery?

Is there a “safe” way to resume this relationship?

For so long as you are married having sex with any person aside from your wife is a crime in NC.
In so far as the other aspects of the divorce, if you already have an agreement regarding those issues resumption of the affair will not reopen the door for negotiation of those issues.
