My husband and I stopped sleeping in the same room. We also started living separate lives while we were living together. When I could afford to physically move out I did. I’ve been physically separated for 6 months and we lived together separately for 6 months. Would I be eligible to file for divorce under these circumstances?
No, the law in North Carolina requires that you actually live in separate residences for one year in order to move forward with a divorce; sleeping in different rooms of the same residence won’t suffice.
