# Separation

Greetings. If you want to deal with property division or alimony, then you need to have a separation agreement or file a complaint for equitable distribution or alimony. If you only want a divorce - go ahead and file for one. Thank you.

Thanks for the response. There’s not property, alimony, or child support. Just a plain divorce.

Do you have to file a legal separation agreement? I’ve separated for a year now but we didn’t do a separation agreement. We’ve both are living as if we were never married. We are ready to bring closure to this marriage so do we have to file a separation agreement and wait another year or can we do it now?
