Evidence of settlement negotiations are not admissible in court, but the text messages may be admissible if they prove that your partner has a pattern of neglect towards your child.

With no separation agreement and a possible custody issue over a child due to parent disagreement of best interest because parent who works and goto school vs a parent who doesnt work nor can drive with no stable home.
Question:
Do text messages and emails of one person stating they give up one day on all rights and then change their mind the next day and back and forth repeatedly but unwilling to sign a agreement stand up if litigations occur?
