# Seperation agreemnet

do i need a separation agreemnet before i can file for divorce? We have been seperated for over a year now and i am in desperate need of a divorce and am about to file on my own.

If there is marital property that needs to be divided and/or a claim for alimony you either need a separation agreement that settles those issues prior to getting a divorce, or you need to include these claims in your Complaint for divorce in order to preserve your rights to have the court determine Equitable Distribution and Alimony.
