When two people get divorced, and they make a sep agreement that spells out that wife gets 1/2 of 401(k), husband gets 1/2 401(k) and so forth, how do you deal with division of possible future Social Security benefits? Can the disposition of Social Security be specified in a sep. agreement or does the gov’t use its own rules for dividing up social security when folks are divorced?

Since SS is governed by federal law, it can not be addressed under the equitable distribution laws which are individual to the state.
