You have to sue him for breach of contract. He probably thinks it’s not a big deal because it’s not a court order but your separation agreement and the terms of it are enforcable. Is he still paying his child support?

You may take your husband to court for breach of contract and he will be ordered to make restitution.

He “graciously” gave me child support but did not pay the alimony…I just wanted to find out if our agreement is enforceable…which he obviously doesn’t think it is.

My ex husband and I separated in January '06. In order to save money, we did the property settlement agreement ourselves, had it notarized, and file with the register of deeds. Now he has deciced not to follow the agreement. What legal recourse do I have? Can I take the order to a judge and have them enforce it? The main issue is spousal support. We agreed that it would last for a period of 4 years, and he arbitrarily decided to end it early because of “money problems”…yet he makes 100k a year, lives very well…new cars…new house…etc.

I have 2 children and make a pittance compared to him…and would appreciate any advice. Thanks.
