Wants to separate our children for visits


My soon to be ex lives with his girlfriend and a dog in a 2 bedroom luxury apt., We have 6 children and he says he can’t take all of them at once he can only take 3 at a time because it’s too much for one person.I let them go because I don’t want to be “that mom” but can a judge require he takes the 6 girls collectively instead of splitting them up?


Yes, a judge could require that custodial periods be with all 6 children at the same time if the judge determines that it is in the children’s best interests that they not be divided during visitation time with their dad. Child custody is determined using the best interests of the children standard. However, it would be unlikely that a judge would allow the father to have overnight visits with all 6 children at once because a 2 bedroom apartment is not adequate and conducive for that many people.
