What are my rights?

You should not leave without consulting an attorney, it is impossible to properly advise you on your legal rights without a full review of the specific facts in your case.

All assets that were acquired during the marriage, unless they were acquired via an inheritance, are marital property. These items will be divided equally between you, the name on the proprety does not matter.

My husband is active duty military in SC since 10/1/06. His orders end 09/30/07 at which point, he will go back to resereve status and move back to NC. I am here in SC with him but plan to go back to NC in August 2007. I am on leave of absence from my job so that our family can be together. We own 7 rental properties in NC and my nanme is on the deed to 4 of the 7. We just sold our primary residense in NC and received a hefty profit. We have 2 small children. He has 2 bank accounts, one of which is with his mother. We do not have a joint account and I’d like to establish one with the profit we made on the sell of our primary residence. However, he does not. What are my rights if he were to leave me today. I do not have access to anything!
