Dear rummy:

The actual hearing should be during the week that the attorney set the hearing for (if not the actual day). Have you talked to your attorney about this?

Yes, both attorneys should show up for all court dates, unless they enter into a consent order prior to the date of the hearing and only one of the attorneys is there to handle the same. Yes, both parties should attend all hearings also. I believe it is always good to let your judge know the situation and help them remember your case. Thank you.

The response posted above is based upon the limited factual information made available and is not intended as a full and complete response to the question. The only reliable manner to obtain complete and adequate legal advice is to consult with an attorney, fully explain your situation, and allow the attorney sufficient opportunity to research the applicable law and facts required to render an accurate opinion. The basic information provided above is intended as a public service but a full discussion with an attorney should be undertaken before taking any action.

my lawyer setsa calendar date at the court for a Motion for Restoring my Separate Property (in connection with divorce).
Is this date set only to obtain a date for hearing? Or does it mean that the hearing itself will be held on this specified calendar date?

Also, do the lawyers of both parties need to be present on the specified calendar date? And do the plaintiff and defendant need to attend this session?
