In a separation agreement, what is the basic premises behind living separate lives for one year? Does it mean it’s fine if the spouse living outdside the house comes and uses the washing machine and dryer? Or, is it meant, that no contact we be displayed between these two individuals during the one year and one day process. Thanks
North Carolina requires two parties to live separate and apart for one year prior to filing for divorce. I believe the legislative intent is to ensure that the parties have had time to determine whether reconciliation is possible before moving forward with a divorce.
Living separate and apart means that the parties are living in separate residences. It is fine that they have some contact, using the washer and dryer will not destroy a physical separation.
