If your name is not on the loan the creditor will not pursue you for these payments. It is technically marital debt, however debt created shortly before the separation can be scrutinized more closely by the court and may be considered separate debt.

My wife is planning on buying a new car before we separate. I guess she is getting a family member to co-sign on the loan. Am I liable for these debts if she does not pay? Will it affect my credit?
