Also, he came in to this relationship with NOTHING but the clothes on his back. I have a good career, my own vehicles, and my own house. Would I have to pay him spousal support? We have NO children together (thank God!). Thanks again.

Can I get an annulment?
Generally the answer to this question is no. Annulments are available only in limited circumstances in North Carolina. These circumstances include all marriages between any two persons nearer of kin than first cousins, between double first cousins, between persons either of whom is under sixteen years of age, between persons either of whom has a spouse living at the time of the marriage, between persons either of whom is at the time physically impotent, or between persons either of whom is at the time incapable of understanding the marriage vows. Additionally, a marriage contracted under the belief that the wife is pregnant, followed by the separation of the parties within 45 days of the marriage, which separation was continuous for a period of one year, shall be annulled unless a child was born to the parties within ten months of the date of separation.

I know this probably doesn’t help much…
I read another post on here about a spouse trying to get 1/2 of everything after they had only been married 8 months. From what the attorney posted, it makes no difference the length of the marriage, she was entitled to 1/2 of everything, even his retirement fund. I would think that it may be a bargaining chip in his favor that you have all the assets. You need to get a separation agreement drawn up as soon as you can.

Greetings. I cannot advise you SC law, but it does not sound like you have grounds for annulment under NC law. My suggestion is that you hire an attorney and get a separation agreement drawn up. Also, I would recommend that you see a doctor if you are experiencing health issues…we want you to stay healthy! Good luck.

Hi, I have been married for almost a year and it has truly been hell. He starts arguments constantly and I am really stressed out. My blood pressure is at stroke level and I can’t take it anymore. We got married in Myrtle Beach, SC Jan 1 2005. Then I recently found out that he may have another child who is 16!!! So that makes 4 children!!! I deal with so much drama between his ex-wife, his children and ALL of his insecurities due to previous realationships. When is it to late to file for an annulment and would I have to file in NC or SC? Please advise and thank you in advance for your time.
