You can get a divorce with ED and Custody up in the air. You just need to make acknowlegements that they are to be settled. I am not sure the wording on this, but if you read enough posts you’ll find it.
No, the divorce cannot be contested unless you have resumed marital relations or the court lacks jurisdiction.
