You would assert your claims in the same lawsuit and title them as counterclaims. If the issue is set for hearing the judge will hear evidence from both of you regardless of who sets the hearing.

My spouse has filed the Complaint against me for DIVR, ED, CSUP and CUST. We have settled the CUST and CSUP but the ED and DIVR has not been settled. I have responded to the Compliant and the Wake-Dom-17b and Wake-Dom-18. I want to file a Complaint for DIVR and ED to make sure that I have myself covered but I am not sure if I need to have the same information listed and the same file number that is listed on hers so that they are linked together. I also do not know exactly what to list on my complaint and to also make sure that my hearing is at the same time as my spouses’ hearing (no date has been set yet from her attorney).

I keep trying find out all that I can on-line but it is not 100% clear. I have tried to use an attorney but I cannot afford one so I am doing this myself.
