The STBX and I have each hired attorneys and have begun the gathering of documents related to the marital property. The year and a day occurs on September 24th. Can he file for and be granted divorce without the ED process being complete? Does there need to be a motion filed before the year and a day occurs on ED?

Yes, divorce can be granted while ED is still pending. As long as one of you has filed for ED before the divorce is finalized, the claim is preserved and the divorce will not cut off that right.
