Yes, your ED claim must be filed before the divorce is granted, however you can file it after he has filed for divorce. After he files you are given thirty days to respond, before that thirty days is up you need to file a claim for Equitable Distribution.

Am I correct in assuming that if I want an equitable distribution of property, this will have to be done before my stbx files for divorce? We have been separated since November, and I don’t want him filing for divorce without getting what I am entitled to.
