I’m in the middle of an equitable distribution case with my now divorced wife. My question is kinda complicated. I was in the military for 4 years prior to getting married. During the course of my marriage I used marital funds from my 401K to purchase back my 4 years of military service credits. Therefore, instead of 21 years in my local government account, I have 25 years of retirement credits. How do I ensure that my military service credits are not considered marital? My lawyer doesn’t know how to help me in ensuring that I’m not being assessed the full 25 years while we divide up the assets.
