A quick google search I found cases where it was allowed and cases where it was not but nothing in NC. But as a creditor he had a resposiblit to notifiy you of his bankrupcy. I would run not walk to an attorney quickly.

My ex husband supposedly filed my E.D. in Bankruptcy court to avoid paying. Another attorney has hinted to me that this is not allowable. Is this a fact, and if so, what is the statute of limitations from the date the disbursement was to be made that I can follow through to get my award? (I also have a letter from the bankruptcy attorney that I was not notified of the hearing). Thank you for any response! WG
