Expert Witness

If an expert witness is brought in to testify, should my attorney have been notified prior or can an expert witness come in as a surprise witness? Also, is the attorney who brought the expert witness in for testimony allowed to confer privately in the hallway prior to trial?

An attorney can call a surprise witness, so long as the local rules in your county do not require the exchange of a witness list prior to trial. The attorney may confer privately with the witness prior to trial.
