My questions are, when I file for divorce, does the wife have interest in the property if I purchased before we married, and it is only in my name. Also, how many years do you have to be married for the property to be an issue, if is not now.
If the property was purchased before marriage, and you have not made a gift of the property to the marriage, then it is separate property. If there was active appreciation in the property during the marriage through her, or your, labor then that may be marital property. Also, she may be entitled to half of any money spent on the property during the marriage if the money was marital property. The number of years you are married do not matter.
