My husband ex is pregnant by another man and wants to give this child my husbands last name. She kept his name after the divorce. Can she do that.

If the ex-wife kept your husband’s last name when they divorced, then that last name is also HER last name. If she doesn’t want to give her baby the baby-daddy’s last name, then it would stand to reason that she would give it HER last name, which happens to be the same as your husband. As long as she doesn’t try to put your husband down as the father, then I don’t see how it would matter (legally or otherwise) to you or your husband.
