When the plaintiff’s attorney send me Interrogatories, does it mean they are not interested in mediation?
(1) You can ask the opposing party/attorney for a Word version of the discovery so you can fill in your responses to each interrogatory.
(2) Plaintiff could file a motion to compel asking the court to compel you to produce the missing tax returns. If you do not produce all of the requested tax returns, then you’ll need to provide an objection and reason for not producting them.
(3) No. Sending interrogatories likely means they need more information. It is quite possible that they are still interested in settling in a mediation.

Anna, Can I object by stating that plaintiff is already in possession of the tax returns because they were filed jointly.
Yes, you can object to any request for documents which are already in the possession of the other party or are equally available to the other party.

Thank you very much, Anna. I have no income from 2023-2025 and have Federal transcripts to prove them. Since these Transcriptsfrom IRS can serve as affidavits, would these be enough without producing statements/searches from NCDOR to Plaintiff’ request of documents in Rule 33/34?
That may be enough depending on the exact wording of the Request.
