We have separated and tried sell our home with no luck. How could I buy my husband out? Home is worth $350k and we owe $200k, so we each have about $75k equity in it. Would I have to pay him $75k and assume the whole mortgage? Or would he have to help some on mortgage since it is marital debt? Thanks!
The way the buyout typically works is that you would give him half of the equity in the home, and you would refinance the mortgage into your name. That way each party receives half of the equity, and the party no longer residing in the home has no liability with regard to the mortgage.
