Husband and I have been married 15 yrs. My father has in his will that upon his death my brother and I will receive 40 acres between us. Working on separation papers at this time; is there any way that husband can get a part of this land or proceeds in separation or divorce, not sure how to put this in words of separation. If father dies before separation is done, does husband get any of it?
No, an inheritance is the separate property of the spouse receiving it, and is not part of the marital estate.
