You could use the rental trailer as a solution but not in the same residence. NC does not recognize you to be separated until one of you move from the marital home and you begin living separate and apart. It will also help everyone to use that year to adjust to the change…
No, you have to actually live in separate residences, it is not sufficient to occupy different parts of the same house.

We have a 2 story house. Is it possible to separate with one of us living in basement? We are looking at cost burden of moving one of us out immediately and using year of separation that would allow us equal daily contact and care with our 15 & 9 year old children until everything is finalized. We have a rental trailer on a joining property but it is currently rented out to a family. It would be more economically thinking if we could use the 2 properties instead of purchasing or renting another home during year of separation.
