I have a question about distribution of Marital property. If you and your spouse purchased a home after one was awarded money from a personal injury case does the home become sole owned by the spouse who’s monies paid for it. My husband and I are married and have been together for 9 years of those 9 years he never worked due to an injury that occured by a automobile accident I was the sole financial provider of the home until he was awarded SSD and then he had a minor contribute to the home due to the fact his SSD check was less than 300.00 a month. When his lawsuit for the accident came thru we purchased a home now we are seperated and looking to get a divorce will the home be his or is it still ours?
If the home was purchased during the marriage it is martial in nature, without regard to the source of funds.
