If you have gone through mediation once you probably don’t have to do it again. I thought I remember seeing some sort of “Waive Mediation” document somewhere…
If you have not been through the court ordered mediation process, then you will need to go through mediation again. If you have already been through the court ordered mediation process you can set a trial date and ask the court to resolve these issues for you.

My wife and I went to a mediation session in the spring but the talks went nowhere. We ended up not separating at the time but unfortunately we will this time around. My question is do we have to go to another mediation session? The issue never went before the courts.
