Dear kasatkina:

Greetings. What will your spouse say when they receive the complaint?

The response posted above is based upon the limited factual information made available and is not intended as a full and complete response to the question. The only reliable manner to obtain complete and adequate legal advice is to consult with an attorney, fully explain your situation, and allow the attorney sufficient opportunity to research the applicable law and facts required to render an accurate opinion. The basic information provided above is intended as a public service but a full discussion with an attorney should be undertaken before taking any action.

He doesn’t say much, we haven’t seen each other in a year and a half. He wants the divorce as much as I do.

Dear kasatkina:

Greetings. Well, if you both consent, then you can file it in the state where your spouse lives. Under our statute, you must live in North Carolina for six months prior to filing for divorce. Best of luck.

I am in the military and stationed overseas. I was married in MO but cannot file for divorce there because I no longer meet the residency requirements. My home of record is NC. Everything I own, including my drivers licence, is from NC but I don’t think I meet the requirements there either, since I have been living outside of the state for 4 years. What can I do?
